Terms and conditions
Article 1 - General
These terms and conditions apply to all offers, orders and agreements made by Stichting Justice Tribune Foundation (“JTF”), publisher of the International Justice Tribune (“IJT”), and exclude any other terms and conditions.
All stipulations in these terms and conditions shall apply mutatis mutandis to the (directors of) partners, directors and employees of JTF, or any third parties or auxiliaries brought in by JTF.
Article 2 - Payment
All orders must be prepaid in full, in the correct currency.
The following payment methods are acceptable in this regard:
(i) via PayPal, by MasterCard, Visa or American Express. Please find the terms of payment via PayPal: https://www.paypal.com/us/webapps/mpp/ua/useragreement-full
(ii) by bank transfer to ABN AMRO Bank, account nr. (IBAN): NL36ABNA0454970846, BIC: ABNANL2A.
Upon purchase you are requested to e-mail a copy of transfer, along with your personal information (name, address, ZIP code, country, profession and organization) to the e-mail address email@example.com.
All orders are regarded as fixed and subscription payments are not refundable after the first issue has been dispatched and/or online access has been activated.
Article 3 - Subscription and renewal
The initial subscription is entered into for period of one (1) year.
The subscription is automatically (tacitly) renewed after expiry of aforementioned period, unless
previously indicated otherwise by subscriber in writing. At least two (2) months prior to the expiry of
the one (1) year period, subscriber will receive an alert from JTF in this regard.
Unless subscription is not renewed in connection with the above, business subscribers are subject to an automatic (tacit) renewal of their subscription for another one (1) year period, whereas private subscribers are subject to an automatic (tacit) renewal of their subscription for an indefinite period of
time, with a notice period of one (1) month.
Article 4 - Delivery
IJT is delivered every other week, observing a summer recess from July 15th to August 15th, as well as a winter recess from December 15th to January 15th.
JTF is entitled to cancel an order in the event of a force majeure that prohibits envisaged delivery.
Article 5 - Privacy
JTF, or any third parties or auxiliaries brought in by JTF, will process all personal data in order to supply the ordered subscription and will only register personal data for administrative and promotional purposes.
All personal data will be processed in accordance with the laws of the Netherlands and will not be sold to third parties for commercial purposes.
Article 6 - Intellectual Property
The content of IJT made available remains the property of JTF or its licensors and is protected by international copyright laws. All such rights are hereby reserved by JTF and its licensors.
Subscribers may solely store, print and display the content supplied for own personal use.
Subscribers are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content supplied, nor may any such content be used in connection with any
business or commercial enterprise.
Article 7 - Liability
The content provided by JTF in connection with IJT is expressly provided without any guarantees, conditions or warranties as to its accuracy.
JTF and it suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and shall not be liable for any damage whatsoever, including but without limitation to any direct, indirect or consequential damage.
JTF is not liable if for any reason its website may be unavailable at any time or for any period.
Article 8 – Indemnity
You hereby expressly agree to indemnify and hold harmless JTF, its directors, officers, employees, consultants, agents and affiliates, from any and all third party claims, liability, damages and/or costs, including but not limited to legal fees, ensuing or arising from any purchase through this website or use of the IJT subscription.
Article 9 - Variation
JTF shall have the right in its sole discretion at any time and without notice to amend, remove or vary the offered products and/or any page of its website.
Article 10 - Invalidity
If any article in these terms should be found to be invalid or be nullified, the other articles shall as far as possible retain their effect, with the invalid or nullified article being replaced by an article that is as close as possible to the purport of the original article.
Article 11 - Complaints
JTF operates a complaints handling procedure which is deployed in order to try to resolve disputes when they first arise. Please let us know if you have any complaint, comment or claim.
Any and all claims for missing print issues should be made within two (2) months of publication or date of order, which claims are be submitted here.
Article 12 - Tax
With the payment of your donation you become a member of JTF. JTF is a public benefit organization and therefore not collecting VAT for its memberships. Donations to JTF can be deducted from taxes in the Netherlands and many other countries. Contact your accountant to check if this is possible in your country.
Article 13 - Applicable Law
These terms and the agreement created by acceptance of these terms shall be governed by the laws of the Netherlands. All disputes arising in connection with these terms or further agreements resulting therefrom shall be submitted to the competent court in the Netherlands.
